Terms

These cover this website, its documentation, and the software as this project publishes it. They do not cover an instance you install: that runs on your machine, under your organisation’s rules. The licence covers the code, and the privacy notice covers personal data.

In short

  • Kanban Toolkit is free software under the AGPL-3.0-or-later, and nothing here limits what that licence gives you.
  • There is nothing to buy and no account to make. No plans, no trials, no invoices.
  • What you install is yours. This project does not host it, cannot see it, and cannot restore it — keep your own backups.
  • No warranty, and liability is limited, exactly as the licence already says.
  • There is no “I agree” button. Using the site means these terms apply to the site; the licence applies to the code.

1. About these terms

These terms apply to the website at this address, the documentation it links to, and the builds this project publishes. “We” and “us” mean the maintainers of the Kanban Toolkit project, who run this site.

They do not apply to an instance of Kanban Toolkit that somebody installs. That deployment has its own operator, its own users and its own policies, and this project has no relationship with it — which is the point of the software being installable in the first place.

2. The licence does the heavy lifting

The source code is licensed under the GNU Affero General Public License, version 3 or later. Nothing in these terms limits the rights that licence gives you, including the right to study, modify, run, self-host and redistribute the software under its conditions. If these terms and the licence ever disagree about the code, the licence applies.

The one obligation the licence does add is the point of it: a modified version, run for other people over a network, offers them its source.

3. Using this site

You may use the website and its demo for any lawful purpose, personal or commercial. You agree not to attack or overload them, probe them for access you have not been given, or use them to break a law that applies to you. We may block or limit access to the site for use that does, and nothing we do there affects the copy of Kanban Toolkit on your own machine.

4. Your instance is yours

When you install Kanban Toolkit, you run it, you hold the data, and you choose who may use it. This project does not operate it, has no access to it and keeps no copy of it. That has consequences worth stating plainly:

  • You keep the backups. Nobody here can restore your instance for you.
  • You choose the policies. Identity providers, who is invited, what is audited, how long data is kept, and what your own users are told — all yours to decide and to document.
  • You own the support relationship. The documentation and the issue tracker are help; they are not a service desk, and no response time is promised.

5. No warranty

This website, its demo, the documentation and the software are provided “as is”, without warranty of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not promise that they will be available, secure, free of errors, or suited to your needs. This matches the disclaimer in the licence. Where the law does not allow an exclusion like this, it does not apply to you.

6. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for damages arising from or related to this site, the documentation or the software — including indirect, incidental, special or consequential damages, and lost data, lost profits or lost business — however caused, even if we were told such damages were possible. Where liability cannot legally be excluded, it is limited to the maximum extent the law allows. Nothing here excludes liability that cannot be excluded, such as for fraud, or for death or personal injury caused by negligence.

7. Changes

The site and the software change over time, and these terms may change with them. The date at the top is the current version, and the history is in this repository — there is no separate change log. If a change matters, the release note for the tag that carries it says so.

8. Contact

The issue tracker is where anything about these terms goes, and that includes a security problem.
